Tuesday, 9.10.2007: Radio Free Asia Counter-Sues The Cambodia Daily

Because of the Phchum Ben Cambodian National Holidays, the next publication will be the editorial on Sunday, 14 October 2007. The next translations from the Khmer press – whatever appears on the newsstands in the meantime – will be put together on Monday, 15 October 2007 and published late in the night Monday/Tuesday 15/16 October 2007.

“Phnom Penh: The lawyer and representative of Mr. To Serey, a reporter of Radio Free Asia [RFA] in Cambodia, filed a counter-complaint against The Cambodia Daily with the same subject of the complaint that RFA was sued, based on the accusation of a copyright violation.

“A report from the court said that meanwhile Mr. Kry Sok Y, prosecutor at the Phnom Penh Municipal Court, is working on the complaint of Mr. Suy Chhunhak, the lawyer and representative of the publisher of The Cambodia Daily, who had sued RFA based on the accusation of copyright violations, claiming that RFA had copied, faxed, and e-mailed all articles published by the newspaper to Bangkok and to Washington D.C.; Mr. Hem Honarith, the lawyer and representative of Mr. To Serey, the reporter of RFA in Cambodia, filed a complaint on 25 September 2007 against the lawsuit of The Cambodia Daily.

“On 8 October 2007, Mr. Hem Honarith refused to comment on this issue to journalists, because he does not have the habit of talking with journalists. However, a source hinted that the subject of the complaint is an accusation of defamation, combined with the content of the complaint against The Cambodia Daily.

“It should be remembered that on 4 September 2007, Mr. Suy Chhunhak, the lawyer and representative of The Cambodia Daily’s publisher, had filed a complaint against RFA in Cambodia, based on the accusation of a violation of copyright, enclosing some pieces of evidence.

“According to the lawsuit, The Cambodia Daily discovered that RFA had copied, faxed, and e-mailed abroad all articles published by The Cambodia Daily since 2006. Mr. Kem Sos, the RFA executive director of the Khmer and English services, also admitted all these points.

“Therefore, in order to seek a solution and to end the case, The Cambodia Daily demanded $15,000 in exchange for the use [of articles of The Cambodia Daily] so far. However, RFA agreed to compensate US$5,000 only. Thus, The Cambodia Daily filed a complaint to the court for US$20,000.

“At the first stage, Mr. To Serey stated to the court that he really copied all articles published in The Cambodia Daily and sent them abroad, but he did it at Mr. Kem Sos’s order. As for the copies sent to the American national Ms. Susan, they were just for her personal reading.

“According to the answer, the court summoned Mr. Kem Sos for questioning about the process of this case. Hence, when Mr. To Serey filed a counter-complaint [against The Cambodia Daily], there is wide interest to wait and see the decisions of the court over these two complaints.” Rasmei Kampuchea, Vol.15, #4410, 9-15.10.2007
