Samdech Hun Sen Rejects Allegation that He Is the Person Who Ordered Funcinpec to Withdraw Lawsuit

“Samdech Hun Sen, the Prime Minister of the Cambodian government, rejected the allegation of a number of ill-willed and ignorant young people, claiming that he had imposed an order on Funcinpec to withdraw the complaint against Samdech Krom Preah. Meanwhile, Samdech claimed that he did not order Funcinpec, but as head of the royal government, for reasons of national stability ahead of looming elections, and for making all parties agree to participate in the free and fair elections, he had considered providing some recommendations to Funcinpec to negotiate to end the complaints out of court. Moreover, it was not an order imposed by him.

“Samdech Prime Minister stated so in the weekly Council of Ministers meeting in the morning of 19 January 2007, following the allegation that he ordered Funcinpec to withdraw the complaint against Samdech Krom Preah.
Having made a statement in the Council of Ministers meeting with the participation from Funcinpec officials, he claimed that it was not an order, but he just provided some recommendations, and it was these recommendations to which the Funcinpec leadership referred their party’s meeting, examining it and then deciding.

“Concerning this case, Samdech said that he spent time working on it at 10:30 p.m. on 17 January, to coordinate with Funcinpec leadership through mediators who had a close relationship with Samdech Krom Preah. Samdech made this effort in coordinating and providing recommendations as head of the royal government, as he did not wish to see political parties lodge complaints against each other, and he wanted to safeguard non-violence and justice for the forthcoming elections. However, people who had not been involved in this effort told a mediator that they had terminated the negotiations already. Meanwhile, some opportunists acted to break up the partnership between the CCP and Funcinpec. He regarded the accusation of ordering to withdraw the complaint as a serous insult, because it is an insult to say that the head of the royal government suppressed a party. The accuser had said that Funcinpec was under the influence of the CCP. Meanwhile, he claimed that some ignorant officials who were ousted from office and dismissed from Funcinpec took advantage of the above event to extend their influence, and he advised ill-willed and ignorant young persons not to break the alliance between the CCP and Funcinpec, and he appealed that this unfortunate event should not become the pretext for political maneuvers. He asked to reject the implications of the above case by this morning (the morning of 19 January), and he requested the court to continue to work on these files so that the court will seek justice. He also appealed to the Ministry of Justice and to Funcinpec to control ill-willed young people, and he told the court to continue its procedures to decide with justice who won and who lost in this case.

“It is noticed that the information on the negotiations to terminate the complaint in the court between Funcinpec and Samdech Krom Preah leaked approximately a week ago. Some news sources claimed that Mr. Nhek Bun Chhay was willing to withdraw the complaint, and negotiated to end maintaining the complaint about giving Mr. Ly Chhoung’s company the old headquarter of Funcinpec, located near the Chroy Chongva bridge, and Mr. Nhek Bun Chhay’s Funcinpec was willing to take the new headquarters located in Chong Chao commune. Some news claimed that this negotiation had not been terminated yet, but it augured well for Funcinpec that Mr. Ly Choung was buying the old headquarters. He officially claimed that Funcinpec made a statement to deny this information, early this month, saying that there was no mediation outside the court, and it encouraged the court to continue its procedures. However, the negotiations above were made public after Samdech Prime Minister Hun Sen made a statement to reject the allegation that he was the person who imposed an order on the Funcinpec leadership to withdraw the complaint, but he claimed that he only suggested to the Funcinpec leadership to withdraw the complaint.

“It should be underlined that Samdech Krom Preah lodged three complaints at the Phnom Penh municipal court against Mr. Nhek Bun Chhay’s group. The first complaint was the rejection of the results of the party congress of 18 October 2006. The second complaint was the rejection of the circular of the Ministry of Interior that recognized the congress of 18 October, and the third complaint was against Mr. Nhek Bun Chhay on a charge of slander. Funcinpec lodged two complaints against Samdech Krom Preah. One complaint was about a breach of trust over the selling of the old headquarters at Chroy Chongva bridge, and the second was that Princess Marie complained against Samdech Krom Preah raising a charge of adultery. Those were all the penal complaints.

“Analysts state that lodging these complaints against each other was legal, but this involved politics. The two parties wanted to win over each other politically. It was obvious that the complaints above did not give any political benefits to Samdech Krom Preah by seeking justice in the court, but it provided considerable benefits to Funcinpec. Therefore, that was the reason why Samdech Krom Preah wanted to end the complaints out-of-court, but Funcinpec had no intention to do this.” Chakraval, Vol.15, #2641, 20.1.2007
